1. Agreement
These terms and conditions constitute a legally binding agreement between Superior Pools & Spas (ABN 24 678 950 028) and the Client for the provision of pool construction, renovation, and maintenance services.
2. Quotations and Pricing
- All quotations are valid for 30 days from the date of issue
- Prices are subject to change if site conditions differ from those present during initial inspection
- Additional charges may apply for unforeseen circumstances including rock removal or access issues
- A 10% deposit is required to secure your booking
3. Construction Timeline
- Construction timelines are estimates and may vary due to weather conditions
- We will communicate any delays or changes to the schedule promptly
- Force majeure events may affect construction timelines
- Council approval timeframes are outside our control
4. Payment Terms
- Progress payments are required at key construction stages
- Final payment is due upon project completion
- Late payments may incur additional charges
- All prices include GST unless otherwise stated
5. Warranties
- Structural warranty: 7 years on concrete shell
- Equipment warranties as per manufacturer specifications
- Warranty claims must be submitted in writing
- Warranties are subject to proper maintenance and care
6. Client Responsibilities
- Providing accurate site information
- Ensuring site access during construction
- Obtaining necessary permits and approvals
- Regular pool maintenance after handover
7. Variations
- All variations must be agreed in writing
- Additional costs will be quoted before work commences
- Variations may affect project timeline
- Payment for variations is required before work begins
8. Termination
- Either party may terminate with 30 days written notice
- Compensation for completed work will be required
- Deposit is non-refundable after work commences
- Breach of terms may result in immediate termination
9. Insurance and Liability
- We maintain comprehensive public liability insurance
- Workers compensation insurance for all employees
- Client must maintain appropriate home insurance
- We are not liable for consequential losses
10. Privacy
- Client information is kept confidential
- Project photos may be used for marketing with permission
- Personal data is protected as per Privacy Act
